Welcome to the CHEF DIRECT site and thank you for your patronage. Please pay attention to the terms and conditions when ordering or browsing.

Review Terms Carefully
By using this site you will be accepting the terms and conditions, and any order you make is an indication of acceptance of these terms, and signifies agreement to follow and be bound by them. Please refrain from using the site if you do not agree to be bound by the terms of this agreement, and please do not order any products if you do not agree to be bound by the terms and conditions. CHEF DIRECT may, in its sole discretion, change this agreement or any part thereof at any time, therefore every time you order you must read the terms and conditions so that you will be bound by them when you make the next order. So please check the terms periodically as continued use of the site indicates acceptance of any changes.

Description of Service
CHEF DIRECT is a business in the food industry that provides ready-to-cook meals to customers primarily via home delivery. This site promotes the ordering and sales of CHEF DIRECT products. Meals are delivered in pre-packaged sets called Cooking Kits.

Registering Online
Certain information, including personal details, and delivery address, will be required upon registering on CHEF DIRECT.

Choosing a user ID and password is also a prerequisite for registration. Please ensure the secrecy of your password, as CHEF DIRECT accepts no liability for any damages suffered or losses incurred from the use or misuse of your password.

Registration on the CHEF DIRECT site is reliant on your stated delivery address falling within CHEF DIRECT’s specified delivery areas. You can also register if you choose to collect your order from the CHEF DIRECT premises.

Delivery Policy
CHEF DIRECT delivers between 8am to 8pm on the day of delivery stated when you place your order.

Being subject to statutory restrictions, alcohol deliveries will require proof of age on delivery. If the recipient of the delivery is unable to produce the required proof, the sale will be considered null and void.

CHEF DIRECT only delivers to registered users who fall within CHEF DIRECT’s specified delivery areas. Kindly note that there is a delivery charge for items ordered on the site. Check the site to see the amount payable for your specified delivery area.

The person accepting delivery at the specified delivery address may be asked to produce a form of identification for verification purposes, and sign their name on a copy of the delivery note to confirm receipt of delivery.

Any person other than yourself, who receives the order at the specified delivery address, is irrefutably presumed to have your authorization to accept the delivery. On the day of delivery, please ensure that you or an authorized person is present at the delivery address, and that there is appropriate access to the property.

Should there be no one to accept the delivery, the driver will retain the order, and a notice will be left at the delivery address notifying you of the fact. You will be contacted by CHEF DIRECT to discuss alternative delivery times, or arrangements for collection.

If no one is in attendance at time of delivery, CHEF DIRECT reserves the right to charge an additional delivery fee should further delivery be required.

Returns and Refunds Policy
If for any reason you are unhappy with a product purchased from CHEF DIRECT, please keep it refrigerated and return it to the Chef Direct premises in a chilled cooler bag/box within 24 hours of opening the product.  You will be refunded at the sole discretion of CHEF DIRECT.

CHEF DIRECT may elect to have the product collected from you, or have you return the product in a cooler bag/box within the specified period.

Refunds will only be considered after inspection of product.

Cancellation Policy
CHEF DIRECT will extend a full refund if an order is cancelled via e-mail or fax by 8am on the day prior to the delivery date selected when ordering.
Orders cancelled after 8am on the day prior to the delivery date selected when ordering will be charged in full.

Guarantee of Products
CHEF DIRECT guarantees a 7-day shelf life unless otherwise specified or stated when ordering on the website.

7-day shelf life and freshness is only guaranteed provided that products are stored in a fridge with temperature ranging between one and six degrees Celsius.

In the case of collection from premises, CHEF DIRECT can only guarantee 7-day shelf life if the product is in transit for less than 45 minutes, and is stored in a cooler bag/box with ice bricks while in transit. If the product is being used within two to three days, food can be kept in a cooler bag with ice bricks for a longer period of time.

Collection of Products
In the case of collection of products from CHEF DIRECT, please bring a cooler bag/box with ice bricks to ensure that the cold-chain is not compromised.
Cooler bags are available for purchase at the CHEF DIRECT premises.

Payment
Payment must be made via Visa or MasterCard credit cards or by internet bank transfer into the Chef Direct bank account. 

Credit card payments:

  • CHEF DIRECT shall be authorized to debit the amount payable for the products ordered against the authorized payment card supplied when completing your order. Payment shall be debited on acceptance of your order and prior to delivery.
  • By placing an order with CHEF DIRECT and supplying your identity number and payment card details you certify that you are over the age of 18 years old, are authorized to make payment with the payment card and that there is enough money available to cover the cost of the order.
  • For security purposes CHEF DIRECT does not store credit card numbers in any form.

Internet bank transfers:

  • Your order will be processed once the funds reflect in Chef Direct’s bank account. Please fax (086 639 3468) or email (info@chefdirect.co.za) proof of payment and ensure that your order number is used as the reference.
  • By placing an order with CHEF DIRECT and making an internet bank transfer, you certify that you are over the age of 18 years old and are authorized to make payment from the relevant bank account.

Variable/Random Mass Items
Certain items on the CHEF DIRECT site are of variable/random mass. While the CHEF DIRECT site states the average mass of the item as an estimation of cost, when delivered to you, the weight of the item may be slightly more or slightly less.

Cooking Kit Availability
CHEF DIRECT is unable to always ensure availability of all ingredients within a Cooking Kit, and will try to deliver substitute ingredients where necessary.

If we are unable to supply every single Cooking Kit ordered, or in the quantities ordered, you nevertheless agree to accept delivery and pay for the Cooking Kits correctly delivered to you.

Customer Privacy Policy
Your privacy is important and CHEF DIRECT shall take all reasonable steps to protect the personal information of users.

For the purpose of this clause “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from: http://www.polity.org.za/attachment.php?aa_id=3569

CHEF DIRECT does not sell or rent personal information about registered users (such as name, address, email address, telephone or fax number) to third parties.

Credit Card Acquisition and Security
Credit card transactions will be acquired for CHEF DIRECT via PayGate (Pty) Ltd, who are the approved payment gateway for Standard Bank of South Africa. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3), and no credit card details are stored on the website. Users may go to www.paygate.co.za to view PayGate’s security certificate and security policy.

Separate Customer and Card Details
CHEF DIRECT will store customer details separately from card details, which are entered by the client on PayGate’s secure site. For more details on PayGate refer to www.paygate.co.za

Merchant Outlet Country and Transaction Currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is the South African Rand (ZAR). All prices quoted on the site are in South African Rand and are valid and effective only in the Republic of South Africa.

Responsibility
CHEF DIRECT takes responsibility for all aspects relating to the transaction, including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

Country of Domicile
This website is governed by the laws of South Africa and CHEF DIRECT chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature: Postnet Suite 372, Private Bag X033, Rivonia, 2128.
